QUOTES ON SECTION 377

Reaction has been swift to the Supreme Court of India’s order—recriminalizing consensual adult same sex sexual relations. In 2009 the same Court annulled the 150 year old law, commonly known as Section 377, of the Indian Penal Code.

  • "The window of opportunity is still there. It is not just gay rights, but human, minority rights. If you take away right of one section of one minority today, then it can happen tomorrow again." Anand Grover, Lawyer’s Collective and counsel for Naz

  • “We are proud that our culture has always been an inclusive and tolerant one... I hope that Parliament will address this issue and uphold the Constitutional guarantee of life and liberty to all citizens of India, including those directly affected by this judgment.”  Sonia Gandhi, President, Indian National Congress

  • “Today is a great day for prejudice and inhumanity. And a bad day for law and love. But law develops and love is resilient. And prejudice and inhumanity will be beaten back. And Law and love will prevail. The judgement is a disgrace.” Vikram Seth, novelist and poet
  • “We are concerned that this will discourage people from seeking health care, and consulting with doctors, counsellors and health workers.”  Keshav Desiraju, Secretary Ministry of Health and Family Welfare

  • "I think these matters should be left to the individuals. These are personal choices. This country is known for its freedom, freedom of expression. So let that be," Rahul Gandhi, Vice President of the Indian National Congress

  • “We have gone back to 1860.The UPA government will look at all options. The legislative option takes time but I am not ruling it out.” P Chidambaram, Union Finance Minister

  • “It is more a disappointment than dejection. I think that a historic opportunity has being lost. I think it is the position of a medieval mind-set. It is an issue of human rights. It has to be looked upon again.”  Indira Jaising, Additional Solicitor General

  • “We have gone back by many years. None of us can walk into a health care centre for fear of discrimination and blackmailing.” Lakshmi Tripathi, activist

  • “It is the prerogative of the Supreme Court if certain thing is right or not. The Supreme Court is the final arbiter. And the opinion of the Supreme Court must be respected by the Government. It is not proper for me to comment on this matter.”  Kapil Sibal, Union Law Minister

  • “Parliament must decriminalize homosexuality immediately because this verdict is sending out a very wrong message internationally about where India is heading.” Milind Deora, Minister of State for Information Technology

  • "There's nothing "unnatural" in these relationships and I hope the subject is reviewed / law amended at the earliest. In the modern age, every individual has the freedom of choice, and we should respect it." Piyush Goyal, Treasurer, Bharatiya Janata Party

  • “The Aam Aadmi party is disappointed with the judgment of the Supreme Court upholding the Section 377 of the IPC and reversing the landmark judgment of the Delhi High Court on the subject. The Supreme Court judgment thus criminalizes the personal behavior of consenting adults. All those who are born with or choose a different sexual orientation would thus be placed at the mercy of the police. This not only violates the human rights of such individuals, but goes against the liberal values of our Constitution, and the spirit of our times.” Statement by Aam Aadmi Party
